Terms of Service
Last updated: October 16, 2026
These terms are an agreement between you and Elysia Root L.C., a Wyoming limited liability company (Wyoming Filing ID 2022-001141349), mailing address 533, 2FL, 447 Broadway, New York, NY, United States (“PATI.me”, “we”, “us”). By buying or using an eSIM from us, you accept them.
1. Service
PATI.me sells prepaid travel eSIM data plans supplied by third-party network partners. Coverage, speed, and availability depend on the local networks and your device.
Plans are either local-network plans, which connect to a carrier in the destination, or roaming plans, which connect through partner networks. The plan page states which type you are buying.
2. Accounts
You need an account to buy an eSIM, and you must verify your email address before your first purchase. Keep your credentials secure. You are responsible for activity under your account, except activity that results from a security failure on our side or that you could not reasonably have prevented.
We may suspend an account where we reasonably believe it is being used for fraud, resale or abuse. If we suspend an account, you can no longer sign in or buy. We will tell you why unless the law prevents us, and you can contest the decision by writing to abuse@elysia-root.com; if we got it wrong, we restore the account.
3. Device compatibility
You are responsible for confirming that your device is eSIM-compatible and carrier-unlocked before purchase. eSIM support depends on the device model, any carrier lock, and the region where the device was sold.
4. Payments and taxes
Prices are charged in US dollars via Stripe. Prices shown in other currencies are approximate conversions for reference only.
Every plan is a one-time purchase. There is no subscription, no recurring charge, and nothing renews automatically. To use an eSIM again after it expires, you buy a new plan.
We may change prices at any time. The price shown at checkout is the price that applies to that order.
Prices are shown exclusive of any sales, use, VAT, GST or similar taxes. Where we are required to collect such a tax, it is added at checkout. You are responsible for any other tax, duty or bank charge that applies to your purchase, including foreign transaction fees charged by your card issuer.
5. Coupons
Coupons are issued for a limited period and a limited number of registrations. Each coupon can be registered once per account and used once. Coupons have no cash value, cannot be transferred, sold or combined with another coupon, and cannot be reissued if an order is refunded.
Some coupon types limit an order to a single eSIM. We may cancel a coupon that was obtained or used in breach of these terms.
6. Service points
Service points are credit held in your PATI.me account. They can be used only for purchases from PATI.me and cannot be transferred to another customer or business. One point has a purchase value of one US dollar. You cannot buy points, and you cannot withdraw them as cash on request.
There are two kinds of points. Refund points are credited when you choose points instead of a card refund (see below); they represent money you paid us. Bonus points are credited free of charge by us, for example as compensation or a promotion. We record which kind each point is. When you spend points, they are used in the order they were credited.
We pay a remaining balance of refund points back to you when you close your account, when we discontinue the service, and where the law requires it, as described in this section. Bonus points are not paid out in cash in any of these cases, except where the law requires it; they end when your account is closed or the service is discontinued, unless the terms under which we gave them say otherwise.
When you cancel an order you may choose to be paid in service points instead of a refund to your card. If you choose points, we credit the full amount you paid, with no processing fee deducted. If you choose your card, section 8 applies, including any deduction described there.
Points can be spent on part of an order or all of it; the remainder is charged to your card as usual.
Points do not expire. If you want to close your account, tell us at abuse@elysia-root.com. We pay your remaining refund points back to the payment method of the order each one came from, or as described at the end of this section where that is no longer possible, and then close the account. We do not cancel refund points because you close your account.
Where an order is cancelled or refunded because of our own fault, we refund to your original payment method and bear the processing fee ourselves. We do not settle that kind of refund in points unless you ask us to.
We may cancel points obtained by fraud or in breach of these terms.
If we discontinue the service, we give you at least 90 days' notice in the service and by email so that you can use your points. When the service ends we pay any remaining refund points back to the payment method of the order each one came from. Where that is no longer possible — for example the payment is too old to reverse, or the card has been closed — write to abuse@elysia-root.com and we will agree another way with you, such as a transfer to a bank account you give us. Where we cannot reach you to return a balance, we handle it under the unclaimed property law that applies.
7. Issuing your eSIM
After payment we order the eSIM profile from our supplier. This is usually immediate, but it can take longer, and occasionally it fails. If issuance fails and cannot be completed, we refund the order in full.
Your QR code, one-tap install button and manual activation code are shown on the order page in your account.
8. Cancellations and refunds
You may cancel an order from the order page within 14 days of purchase, provided the eSIM has not been downloaded (installed) to your device and no data has been used. Once the eSIM has been downloaded or installed, or any data has been used, the order is non-refundable except where required by law.
After those 14 days you can no longer cancel from the order page. Write to abuse@elysia-root.com if you believe a refund is still due to you, for example because the eSIM was faulty.
Issued eSIMs must be installed (downloaded) within 60 days of issuance. This deadline applies to every plan we sell, and the order page shows the date. It is an installation deadline, not a refund period: it does not extend the 14 days above. After it passes we cancel the unused profile with our supplier and mark the order expired. An eSIM that expires because it was not installed in time is non-refundable, unless you could not install it because issuance was delayed, the profile was faulty or our service was unavailable, or the law gives you a right to a refund.
Once an eSIM has expired, refunds are limited. We will still refund you where you could not use the plan because of something we or one of our network partners got wrong, and in any other case where the law requires it. An eSIM that simply expired without being installed is covered by the 14-day rule at the start of this section; the 60-day deadline does not create a further refund window.
Statutory cancellation rights. Where the law that applies to you gives you a right to withdraw from or cancel the purchase (for example, a cooling-off right under consumer protection law in your country), we refund you as that law requires and we do not deduct any payment processing fee. To use such a right, write to abuse@elysia-root.com with your order number. The refund amount and method are set by the law that applies. As a rule, the part you paid by card goes back to your card, and the part you paid with service points is restored to your account as the same kind of points, or refunded where that law requires it.
Voluntary cancellation. Separately from any statutory right, we let you cancel an unused order from the order page for customer reasons, such as a change of mind. For a refund to your card under this voluntary policy, we deduct an amount equal to the payment processing cost: no more than 2.9% of the amount paid by card plus US$0.30. The order page shows the exact refund amount before you confirm. If you choose service points instead, the full amount is credited with no deduction, as described in section 6. Choosing points never means you give up a statutory right to a refund.
When we receive a refund request, we check whether it qualifies under these terms and the law that applies. Where you are exercising a statutory cancellation right, we refund you, or ask our payment provider to reverse the card payment, within the time that law sets. Other refunds are processed within three business days of the day we confirm they are due. Card refunds go back to the original payment method; because of how card networks and banks work, the money can take longer than that to reach you, and we tell you the expected time when we process it. Service points are credited immediately.
Top-ups. A top-up adds data or days to an eSIM you already have. When payment is complete we order it from our supplier straight away, and once the supplier has applied it to your eSIM the order cannot be cancelled or withdrawn. Under our supplier’s policy an applied top-up cannot be cancelled or refunded, so we do not cancel or refund a top-up that has been applied normally because of a change of mind, data or days you did not use, not using as much as expected, a device setting error, deleting the eSIM, or stopping use for your own reasons.
Network quality and availability depend on the local operator, your location and your device. Data or days left over from a top-up that was supplied normally are not, on their own, a reason for a refund.
If a top-up could not be applied because of a failure at our supplier or on our side, we refund the full amount you paid for it.
These limits do not restrict any right to withdraw, to cancel, to claim damages or any other consumer right that the law does not allow to be restricted. Before you confirm payment for a top-up, you are shown and agree that it cannot be cancelled or refunded once applied.
9. Installation and usage period
An eSIM can be installed only once. Do not delete the eSIM after a successful installation; losses caused by deletion are not refundable.
The usage period is counted from the activation point stated on the plan page. Depending on the plan, this is when the eSIM is installed (activated), when it first connects to a network in the destination, or another activation point set by our supplier.
We recommend installing the eSIM over Wi-Fi and starting to use it immediately at your destination. Note that installing early may reduce your remaining usage time.
10. Data allowance and network management
A plan ends when its data allowance is used up or its period expires, whichever comes first. Where a plan states a daily allowance, the allowance resets on the schedule shown on the plan page.
Network operators may manage traffic, and speeds may be reduced after an allowance is reached, where the plan says so. Actual speed depends on the local network, your location and your device, and is not guaranteed.
Data usage figures shown in your account come from our supplier and are not real time. They typically lag actual usage by about one to two hours, so treat them as an indication rather than a live meter.
Every country and region has areas with weak or no coverage, including indoors, underground and in rural areas. Coverage information and operator lists describe general availability; they are not a guarantee of a connection at a particular address or moment. Please take this into account when you depend on a connection.
11. Acceptable use
Plans are for personal use. If we establish that a plan is being resold or that the service is being abused, we may suspend it, and for a serious breach we may do so without a refund, to the extent the law allows and never withholding more than our actual loss. Any statutory refund or withdrawal right you have is unaffected. You must also comply with the laws of the country where you use the eSIM.
12. Export controls and sanctions
PATI.me is a United States company and the service is subject to US export control and economic sanctions laws. You may not buy or use an eSIM if you are located in, ordinarily resident in, or acting on behalf of a person in a country or region subject to comprehensive US sanctions, or if you appear on a US government restricted-party list such as the Specially Designated Nationals list.
You confirm that none of the above applies to you. We may cancel an order and refuse service where we believe these rules would be breached.
13. Service availability
We depend on third parties, including our eSIM supplier, payment provider and hosting provider. The service may be unavailable for maintenance or for reasons outside our control. We do not guarantee uninterrupted availability.
We may limit or suspend all or part of the service where:
- there is an event beyond anyone's control, such as war, civil unrest, a natural disaster or a national emergency;
- a power cut, equipment failure or a surge in traffic disrupts normal use of the service;
- equipment used for the service needs repair, inspection or replacement, has failed, or a line is cut;
- a change in the law, or an order from a government or regulator, makes it impractical to provide the service;
- a partner ends its service or our contract with it ends, so a partner-provided service can no longer be offered; or
- there is another objective and reasonable ground that makes it impractical to provide the service.
We tell you when we limit or suspend the service. Where an unavoidable reason means we cannot tell you beforehand, we tell you as soon as we can afterwards.
14. Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND THE eSIM PLANS ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.
We do not warrant that the service will be uninterrupted or error-free, or that any particular network speed, coverage or connection will be available in a given place or at a given time. Mobile coverage depends on the local operator, your location and your device.
Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
15. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PATI.me AND ITS OFFICERS, MEMBERS, EMPLOYEES AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR MISSED TRAVEL, BOOKINGS OR CONNECTIONS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.
TO THE EXTENT THE LAW ALLOWS, OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR AN ORDER WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE ORDER CONCERNED. THIS LIMIT DOES NOT APPLY TO ANY LIABILITY THAT THE LAW DOES NOT ALLOW US TO LIMIT.
Where you cannot use the eSIM because of our intent or negligence, we put it right — by refunding you or compensating you as the law and these terms require.
In particular, we do not compensate for a plan you could not use because of how it was installed or operated on your side, such as incorrect installation, deleting the profile, or wrong APN or roaming settings; because of the local operator, such as an outage, maintenance, congestion or a change in its policies; or because your device does not support eSIM or is carrier-locked. Refunds are still governed by section 8 where the eSIM is unused.
The quality of a local operator’s service may drop for a time, and service may be limited in some areas. However, where the essential service you paid for is not provided at all, we give you a refund or another appropriate remedy, according to who was at fault and the law that applies.
Things on your side that we do not compensate for include installing your voucher on someone else's device, misunderstanding the installation or activation steps, and activating the eSIM at home rather than at your destination so that the usage period starts running down. We also do not compensate for data you simply did not use.
Nothing in these terms limits liability that cannot be limited by law, including liability for fraud or for death or personal injury caused by negligence, and nothing limits your statutory consumer rights. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
16. Indemnification
To the extent permitted by law, you agree to indemnify and hold PATI.me harmless from claims, losses and reasonable legal costs caused by your breach of these terms, your misuse of the service, or your violation of any law or of the rights of another person. This applies only so far as the matter is your fault, and it does not apply where you are a consumer and the law of your country does not allow such an obligation.
17. Changes
We may update these terms. For significant changes we will give notice in the service before they take effect, and continuing to use the service after that means you accept them. If you do not accept a change, stop using the service; you may then write to abuse@elysia-root.com and we will refund, in full, any plan you have not yet installed, even if the 14 days in section 8 have passed.
A change to these terms applies to purchases made after it takes effect. Plans you bought before then stay under the terms that applied when you bought them. Where we need to change a term in a way that is to your disadvantage for a plan you have already bought, we do so only with any consent, or by following any procedure, that the law requires.
We may also change what the service offers. We announce such changes in the service. Where a change is to your disadvantage or materially affects your rights or obligations, we notify you individually — in the service or by email — at least seven days before it takes effect.
18. Dispute resolution, arbitration and class action waiver
Please read this section carefully. It affects how disputes between us are resolved.
Talk to us first. Before starting a formal proceeding, send a written description of the dispute and the relief you want to abuse@elysia-root.com. We will try to resolve it with you for 60 days. To the extent the law allows, any time limit for bringing your claim is paused during those 60 days. This step does not extend or shorten any period that the law sets and that cannot be changed by agreement.
Arbitration. If we cannot resolve it, you and we agree that the dispute will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration will be held where you live or by video or telephone, unless we agree otherwise. The arbitrator may award the same relief a court could award to you individually. Under those rules you pay no more than the consumer filing fee and we pay the remaining arbitration costs.
Small claims. Either of us may instead bring an individual claim in small claims court if it qualifies.
No class actions. Claims may be brought only on an individual basis. You and we waive any right to a jury trial and to participate in a class, collective or representative action. If this waiver is held unenforceable for a particular claim, that claim proceeds in court and the rest of this section still applies.
30-day opt-out. You may opt out of arbitration by emailing abuse@elysia-root.com within 30 days of first accepting these terms, stating your name and that you opt out. Opting out does not affect anything else in these terms.
This section does not apply where the law of your country of residence does not permit it.
19. Electronic communications
You consent to receive contracts, notices, receipts and other records from us electronically, by email or in the service, and you agree that electronic signatures and records satisfy any requirement that such records be in writing. You may withdraw this consent by closing your account.
20. Governing law
These terms are governed by the laws of the State of Wyoming, United States, where PATI.me is organised, without regard to its conflict-of-law rules. Disputes that are not resolved by arbitration under section 18 — for example because you opted out of arbitration or a claim proceeds in court under that section — will be brought in the state or federal courts located in Wyoming, unless brought in small claims court, and you and we consent to their jurisdiction. This does not affect any mandatory consumer protections, or any right to bring proceedings in the courts of your country of residence, that the law of your country gives you.
21. General
These terms, together with the Privacy Policy, are the entire agreement between you and us about the service. If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these terms; we may transfer ours to an affiliate or in connection with a merger or sale of the business. Neither of us is liable for a failure to perform caused by events beyond reasonable control, such as network outages, natural disasters or government action.
22. Notice to California residents
Under California Civil Code section 1789.3, California residents may reach our complaint-handling contact at abuse@elysia-root.com, or the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, telephone (800) 952-5210.
